Welcome to The Piano Project Social Media Challenge ("the Challenge," "we," "us," or "our"), operated by The Piano Project, a business based in the State of Utah. By registering for, accessing, or participating in the Challenge through pianoproject.app (the "Platform"), you ("Participant," "you," or "your") agree to be bound by these Terms and Conditions ("Terms"). Please read them carefully before creating an account.
1. Acceptance of Terms
By creating an account or participating in the Challenge, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction), that you have read and understood these Terms, and that you agree to be legally bound by them. If you do not agree, you must not register or participate.
These Terms constitute a legally binding agreement between you and The Piano Project under the laws of the State of Utah, United States.

We reserve the right to modify the rules, scoring system, or structure of the Challenge at any time with reasonable notice provided through the Platform.
3. Account Registration
To participate, you must register an account using a valid email address and, where required, a Facebook profile URL and phone number. You agree to:
- Provide accurate and complete registration information.
- Maintain the security of your account credentials.
- Notify us immediately of any unauthorized use of your account.
- Accept responsibility for all activity occurring under your account.
We reserve the right to approve, deny, suspend, or terminate any account at our sole discretion, including for violation of these Terms or conduct deemed harmful to the community.
4. Email Communications — Consent & Opt-Out
By registering for the Challenge, you expressly consent to receive emails from The Piano Project, which may include:
- Account registration and confirmation emails.
- Daily reminders to log your activity and participate in the Challenge.
- Challenge updates, announcements, and scoring changes.
- Community highlights, leaderboard updates, and motivational content.
- Administrative or legal notices related to your account.
We do not sell your email address to third parties. By opting in to communications, you acknowledge compliance with the CAN-SPAM Act (15 U.S.C. § 7701 et seq.) and any applicable Utah state law governing electronic communications.
5. SMS / Text Message Communications — Consent & Opt-Out
By providing your mobile phone number during registration, you expressly consent to receive automated text messages (SMS) from The Piano Project to the number provided. Messages may include:
- Daily reminders to log your activity.

By consenting to SMS communications, you acknowledge compliance with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and applicable regulations.
6. Payment
If a participation fee is required, it will be clearly disclosed at the time of registration. All payments are processed securely through a third-party payment processor (Stripe). By submitting payment, you agree to the processor's terms of service. All fees are in U.S. Dollars unless otherwise stated.
Refund Policy: All sales are final unless otherwise required by applicable law. If you believe you were charged in error, contact us within 30 days of the charge at PianoProjectChallenge@gmail.com.

- Use automated bots, scripts, or tools to log activity on your behalf.
Active Participation Required. The Piano Project is a participation-based challenge. By enrolling, you commit to actively engaging with the program — doing the daily work, trusting the process, and contributing alongside the community rather than relying on the efforts of other participants. We may, at our sole discretion, remove a participant who demonstrates a sustained lack of engagement from the Challenge without a refund.
Violation of these conduct standards may result in immediate disqualification, removal from the Challenge, and/or permanent account suspension without refund.
8. Intellectual Property
All content on the Platform, including but not limited to text, graphics, logos, and software, is owned by or licensed to The Piano Project and is protected under applicable U.S. copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from any Platform content without our prior written consent.
By submitting content to the Platform (including testimonials, comments, or feedback), you grant The Piano Project a non-exclusive, royalty-free, worldwide license to use, display, and share that content for purposes related to the Challenge and our marketing efforts.
9. Privacy
Your privacy matters. How we collect, use, store, share, and protect your personal information — including your rights to access, correct, or delete it — is described in full in our Privacy Policy.
By using the Platform, you acknowledge that you have read and agree to our Privacy Policy. We do not sell your personal information. To exercise any privacy right, email pianoprojectchallenge@gmail.com with the subject line "Privacy Request."
10. Disclaimers & Limitation of Liability
The Platform and Challenge are provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee any specific results from participation.
To the fullest extent permitted by Utah law, The Piano Project shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your participation, including but not limited to lost profits, loss of data, or personal injury, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid to participate in the Challenge.
11. Indemnification
You agree to indemnify and hold harmless The Piano Project and its operators, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your participation, your breach of these Terms, or your violation of any applicable law.
12. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Utah, and you consent to personal jurisdiction in such courts.
For any dispute or concern, we encourage you to contact us first at PianoProjectChallenge@gmail.com to seek an informal resolution before initiating formal proceedings.
13. Modifications to These Terms
We reserve the right to update or modify these Terms at any time. Changes will be posted to this page with an updated effective date. Your continued participation in the Challenge after any such changes constitutes your acceptance of the revised Terms. We will make reasonable efforts to notify active participants of material changes via email.
14. Termination
We may suspend or terminate your access to the Platform at any time, with or without cause, at our sole discretion. You may terminate your participation at any time by contacting us. Upon termination, your right to access the Platform ceases immediately. Sections 8 through 12 of these Terms survive termination.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
